5K Holiday Sweepstakes – Official Rules

SPONSOR: Credit Sesame, Inc., a Delaware corporation having an address of 444 Castro St., Ste 500, Mountain View, CA 94041 (“Sponsor”).
ENTRY PERIOD: The Credit Sesame 5K Holiday Sweepstakes (“Sweepstakes”) begins 12/1/2023 and ends at 11:59:59 p.m. PST on 12/31/2023 (“Entry Period”). There are two (2) methods of entry.
ELIGIBILITY: The Sweepstakes is offered only in the United States to legal residents of the fifty (50) states, who at the time of entry: (a) are at least eighteen (18) years old and (b) have internet access. Misrepresentation of age, upon discovery by Sponsor, will disqualify the applicable Entrant. Void in Guam, Puerto Rico and where prohibited by law (certain jurisdictions may impose additional eligibility restrictions). Employees, officers, directors of Sponsor and its respective parent companies, affiliates, distributors, subsidiaries, and the immediate family members (i.e., spouses, parents, children, grandchildren, siblings and their respective spouses) and/or those living in the same household of any of the foregoing are not eligible to enter/win a prize in this Sweepstakes.
AGREEMENT TO OFFICIAL RULES: Participation constitutes entrant’s (individually “Entrant” and collectively “Entrants”) full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning the prize is contingent upon fulfilling all requirements set forth herein. Sponsor reserves the right to modify these terms at any time.
HOW TO ENTER: To be entered, Entrants must Sign up for Sesame+ or be enrolled in a current Credit Sesame subscription program in the month of December 2023 and remain a subscriber for 1 billing cycle. To enter by mail without enrolling into Sesame+, Entrants may receive one (1) entry by hand printing their full name, complete mailing address, e-mail address, telephone number, and the words “5K Holiday Sweepstakes” on a plain piece of paper and mailing it in a sealed, stamped, and hand-printed #10 envelope to: Credit Sesame PO BOX 390820, 211 Hope Street, Mountain View, CA 94041. No entry limit. Mail-in entries must include all requested information herein to be considered an entry. Mail-in entries must be postmarked no later than 12/31/2023, and received by Sponsor no later than 1/07/2023. Proof of mailing does not constitute proof of delivery. No copies or reproductions of mail-in entries will be accepted.

RANDOM DRAWINGS: 1 potential winner will be selected in a random drawing from among all eligible entries received by the end of the Entry Period. Odds of winning a prize depends upon the number of eligible entries received..
WINNER ANNOUNCEMENT: Potential prize winners will be notified by direct message or e-mail after the Entry Period conclusion and will be required to respond within the time period stated with their email address, first and last name, and any other information requested by the Sponsor. Noncompliance within the specified time period may result in disqualification. Sponsor is not responsible if a prize message is not received for any reason. In the event that a potential prize winner is disqualified or forfeits the prize for any reason, declines to accept the prize, or if the prize is returned as undeliverable, Sponsor reserves the right to award the prize to an alternate Entrant who will also be selected randomly, even if the disqualified potential prize winner’s name may have been publicly announced. You may request a list of winners by contacting sweepstakes@creditsesame.com.
PRIZE: The winners will receive $5000.00 in the form of a check(“Prize”). No substitution, exchange, or cash redemption of the Prize is permitted. All federal, state and local taxes on the Prize are the sole responsibility of the winner. Prize consists of only the item specifically listed as the prize.
RELEASE: BY ENTERING, ENTRANT AGREES TO (I) RELEASE AND HOLD SPONSOR AND ITS AFFILIATES (COLLECTIVELY, THE “RELEASED PARTIES”) FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, ACTIONS, LOSSES, COSTS, DAMAGES, LIABILITIES, JUDGMENTS, SETTLEMENTS AND EXPENSES (INCLUDING WITHOUT LIMITATION REASONABLE ATTORNEYS’ FEES); (“LOSSES”) OF ANY KIND ARISING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE SWEEPSTAKES OR PARTICIPATION IN ANY SWEEPSTAKES-RELATED ACTIVITY (INCLUDING WITHOUT LIMITATION THE REMOVAL FROM THE REGISTRATION PAGE OF, OR DISCONTINUATION OF ACCESS TO, ANY ENTRIES OR OTHER MATERIALS), OR RESULTING DIRECTLY OR INDIRECTLY FROM ACCEPTANCE, POSSESSION, USE, OR MISUSE OF ANY PRIZE AWARDED IN CONNECTION WITH THE SWEEPSTAKES, INCLUDING WITHOUT LIMITATION PERSONAL INJURY, DEATH, AND/OR PROPERTY DAMAGE, AS WELL AS CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY; AND (II) INDEMNIFY AND HOLD HARMLESS RELEASED PARTIES FROM ANY AND ALL LOSSES (AS DEFINED ABOVE) OF ANY KIND THAT MAY BE ASSERTED AGAINST OR INCURRED BY ANY SWEEPSTAKES ENTITIES AT ANY TIME IN CONNECTION WITH THE ENTRIES, OR OTHERWISE RELATING TO ENTRANT’S PARTICIPATION IN THE SWEEPSTAKES, INCLUDING WITHOUT LIMITATION CLAIMS CONCERNING THE INFRINGEMENT UPON OR VIOLATION OF ANY INTELLECTUAL PROPERTY OR OTHER RIGHTS. Except where legally prohibited, winner grants (and agrees to confirm that grant in writing) permission for Sponsor, and those acting under its authority to use winner’s name, photograph, voice and/or likeness, for advertising and/or publicity purposes without additional compensation in all media now known or hereafter discovered, worldwide and on the World Wide Web, without notice, review or approval. Released Parties are not responsible for lost, late, damaged, delayed, or incomplete entries, entries not received by entry deadline, interrupted or unavailable network, server or other connections, miscommunications, failed telephone, computer hardware, software and other technical failures of any kind, including injury or damage to any person’s computer relating to or resulting from participating in or experiencing any materials in connection with the Sweepstakes, unauthorized human intervention, garbled, jumbled or delayed computer transmissions or other errors of any kind, whether human, mechanical or electronic, including without limitation, the incorrect or inaccurate capture of entry information online regardless of cause that may limit a user’s ability to participate in the Sweepstakes. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds or believes to be tampering with the entry process or the operation of the Sweepstakes; to be acting in violation of the Official Rules or in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
GENERAL CONDITIONS: Personal information submitted by Entrants is subject to the Sponsor’s privacy policy available here. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirements of participation as stated herein or with any provision in these Official Rules. INTERNET CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW INCLUDING CRIMINAL PROSECUTION. Sponsor reserves the right to cancel or modify the Sweepstakes if fraud, misconduct or technical failures destroy the integrity of the Sweepstakes or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the program as determined by Sponsor, in its sole discretion. In the event of termination of the Sweepstakes, a notice will be posted on this page and Sponsor may elect, in its sole discretion, to identify winners and award the prizes by way of random drawing from among all Entrants who had entered the Sweepstakes prior to the time of such cancellation. Use of any automated system to participate is prohibited and will result in disqualification in Sponsor’s sole discretion. All materials submitted become the sole property of Sponsor and will not be returned. Entrants assume all liability for any injury or damage caused, or claimed to be caused, by participation in this Sweepstakes, and the acceptance or use of any prize. Sponsor is not responsible for any typographical or other error in the printing, the offering or the announcement of prizes or in the administration of the Sweepstakes.
Arbitration: Except as regarding any action seeking equitable relief, including without limitation for the purpose of protecting any Sponsor confidential information and/or intellectual property rights, any controversy or claim arising out of or relating to these Official Rules or this Website shall be settled by binding arbitration in accordance with the commercial arbitration rules, in effect at the time the proceedings begin, of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be held in the state of California.
All information relating to or disclosed by any party in connection with the arbitration of any disputes hereunder shall be treated by the parties, their representatives, and the arbitrator as proprietary business information. Such information shall not be disclosed by any party or their respective representatives without the prior written authorization of the party furnishing such information. Such information shall not be disclosed by the arbitrator without the prior written authorization of all parties. Each party shall bear the burden of its own counsel fees incurred in connection with any arbitration proceedings.
Judgment upon the award returned by the arbitrator may be entered in any court having jurisdiction over the parties or their assets or application of enforcement, as the case may be. Any award by the arbitrator shall be the sole and exclusive remedy of the parties. The parties hereby waive all rights to judicial review of the arbitrator’s decision and any award contained therein.
Non-Endorsement: The use of any non-Sponsor trademarks, service marks, logos, or other marks in connection with this Sweepstakes or any prize is not meant by Sponsor to imply the endorsement of the respective owner(s) of such marks, or any affiliation of the respective owner(s) of such marks with the Sweepstakes.
Headings: Headings and captions are used in these Official Rules solely for convenience of reference, and shall not be deemed to affect in any manner the meaning or intent of these Official Rules or any provision hereof.
This Sweepstakes is not sponsored, endorsed or administered by Instagram, LLC, Twitter, Inc., Meta Platforms, Inc., or Community Federal Savings Bank (CFSB).
