Sesame Cash Terms of Service

The Terms of Service/Agreement

These Terms of Service represent an agreement between you and Credit Sesame.

You should read this document along with Credit Sesame’s Privacy Policy and Community Federal Savings Bank’s (“CFSB”) Cardholder Agreement, which you can access at www.sesamecash.com/legal.

What Is the Sesame Cash Prepaid Debit Mastercard?

Credit Sesame is the Program Manager for your Sesame Cash account, which is an account held by Community Federal Savings Bank. Credit Sesame provides administration and operational services to support your Sesame Cash account. Your Sesame Cash account comes with a Mastercard-branded prepaid card (“Sesame Cash Card”) issued by Community Federal Savings Bank.

Your Money Is Held at a Bank and Protected by FDIC Insurance

The money you add to your Sesame Cash account is held in an account at Community Federal Savings Bank.

The money in your Sesame Cash account is insured up to $250,000 by the Federal Deposit Insurance Corporation (“FDIC”).

Description of the Sesame Cash Account

Your Sesame Cash account can be used for purchases at most merchants accepting Mastercard prepaid cards. You may also use your Sesame Cash account to withdraw cash from an automated teller (“ATM”) machine after successful identity verification and after setting up a Personal Identification Number (“PIN”).

To use your Sesame Cash account, you must add money to your Sesame Cash account by direct deposit/automated clearing house (“ACH”) transfer.

You may not load cash to your Sesame Cash Card at any time where the funds balance exceeds $20,000. The maximum daily cash reload limit is $8,000. For additional information on Sesame Cash Card limitations, please see the card limitations schedule included in the Cardholder Agreement.

Your Sesame Cash Card should work abroad at locations that accept MasterCard, with the exception of the following locations: Afghanistan, Cuba, Eritrea, Guinea-Bissau, Iran, Iraq, North Korea, Somalia, South Sudan, Sudan, Syria, and Yemen.

Money loaded to your Sesame Cash account does not earn interest.

Getting Information About Your Transactions

You may check your balance on the Credit Sesame Mobile App or by calling us at 1-877-751-1859. You may obtain an electronic account transaction history covering at least 12 months preceding date on which you electronically accessed the Sesame Cash account by using the Credit Sesame Mobile App. You also have the right to obtain a 24 month written history of Sesame Cash account transactions by chatting with us on the Credit Sesame Mobile App or by calling us at 1-877-751-1859. Bill Pay

With the Sesame Cash Account, you will have access to the bill payment feature (“Bill Pay”) through the Sesame Cash Mobile App which allows you to authorize us to make bill payments on your behalf to third parties. We reserve the right to restrict your access to Bill Pay until your Sesame Account has been open for 30 days or more, and/or your Mastercard Debit Card has been activated.

To initiate a bill payment using Bill Pay, you must provide the name and account number of each individual or company you wish to pay. If the individual or company is not within our database we will not be able to process the payment. Once a payment is authorized, the payment amount will be immediately deducted from the Sesame Cash Account balance. Payments made using Bill Pay take the form of an electronic ACH funds transfer to the payee on your behalf. Please allow up to three (3) business days for electronic ACH bill payment to settle. Payments can only be sent to individuals or companies within our database. Bill Pay payments are processed every business day by 3 AM Pacific Time (“PST”). Credit Sesame reserves the right to refuse to process payments to any individual or company. If the decision is made to refuse a payment, Credit Sesame will notify you on or before the next business day.

Limits: Below are the limits when using Bill Pay which may be modified from time to time depending on card status and prior activity both on this account and on other transactions:

Bill Pay payments may be refused or returned by the individual or company to whom the payment was issued. The determination to accept this method of payment is at the discretion of the recipient. The receiving bank may also return payments in cases of expired or invalid names or account numbers. If the Bill Pay payment is returned for any reason, the payment will be voided and the full amount credited to the Sesame Cash Account the business day after notice of the refusal is received.

There is no fee to use Bill Pay.

Cancelling a Bill Pay payment: You may cancel a single Bill Pay payment as long as it has not been processed for payment each business day before 5PM PST by calling 1-877-751-1859.

Liability for failure to stop payment of a Bill Pay payment: If you request cancellation of a Bill Pay payment within three (3) three business days or more before it is scheduled to be made, and Credit Sesame does not cancel it in time, Credit Sesame will be liable for your losses or damages.

Card Loss and Unauthorized Transfers

Please keep your Sesame Cash Card and PIN safe at all times. If you believe someone has stolen your Sesame Cash Card and/or gained unauthorized access to your PIN, or someone has transferred or may transfer funds from your Sesame Cash account without your permission, please freeze your card within the Credit Sesame Mobile App and contact our Customer Service team at 1-877-751-1859 as soon as possible.

To avoid liability, you must notify us within two business days of learning of the loss or theft of your Sesame Cash Card or PIN. For all other unauthorized transfers, you should notify us as soon as unauthorized transfers are identified, but, in any event, you must notify us within 120 days after the unauthorized transfer was credited or debited to your Credit Sesame account.

Mastercard rules further limit your liability for an unauthorized transfer as follows: Under the Mastercard rules, you will have no liability for a transaction that was not authorized by you if you exercised reasonable care in safeguarding your Sesame Cash Card from risk of loss or theft, and, upon becoming aware of such loss or theft, promptly reported such loss or theft to us by calling us at our Customer Service Number (the “Mastercard Zero Liability Policy”). The Mastercard Zero Liability Policy is subject to change without notice and changes made by Mastercard will automatically apply to your Sesame Cash account.

These provisions limiting your liability do not apply to debit transactions not processed by Mastercard.

If we discover any security issues affecting your Sesame Cash account, we will contact you as soon as possible (See “How Credit Sesame Will Contact You” below).

Liability of Credit Sesame

If a transfer to or from your Sesame Cash account is not completed on time or in the correct amount according to the Terms of Service and/or the Cardholder Agreement, Credit Sesame will be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance, if, through no fault of ours, you do not have sufficient funds in your Sesame Cash account to make the transfer, for any circumstances beyond our control, in circumstances set forth in the Terms of Service and/or Cardholder Agreement, or as otherwise provided in applicable law.

If we do not facilitate a transfer, we’ll let you know as soon as possible using one of the channels described in the “How Credit Sesame Will Contact You” section below.

Fees

The full list of charges are set out in the fee schedule provided separately and included in the Cardholder Agreement.

You may have to pay other costs, taxes, or charges in relation to your Sesame Cash account from other financial institutions or entities. For example, other banks may charge you a fee for transferring funds to your Sesame Cash account.

Sharing Your Information

By accepting these terms, you agree to allow Credit Sesame to use your information to make and receive payments on your Sesame Cash account. If you would like us to stop using your information to make and receive payments on your Sesame Cash account, you must close your Sesame Cash account. However, even if you close your Sesame Cash account, Credit Sesame may keep your personal data and use it where permitted by law. In addition, you agree to allow Credit Sesame to disclose and share your information with third parties as required to process your requests and transactions, and with companies providing related services, as permitted by law. How Credit Sesame Will Contact You

Credit Sesame may contact you in English via the Credit Sesame app, or through your email, phone, Mobile App instant notifications, and mailing address. Please let us know of any changes in your email, phone, or mailing address.

Closing Your Sesame Cash Account

You can close your Sesame Cash account at any time by calling Credit Sesame at 1-877-751-1859 or chatting with a customer service representative in the Credit Sesame Mobile App.

You must repay any money owed to Credit Sesame for fees before closing your Sesame Cash account. Once the Sesame Cash account is closed, you will no longer have access to your Sesame Cash account and your Sesame Cash Card will not work.

In addition, Credit Sesame may close your Sesame Cash account if we believe you have:

  1. broken the terms of this Terms of Service, or any of the other related agreements;
  2. violated the law or attempted to violate the law;
  3. put Credit Sesame in a position where it might violate the law;
  4. provided false information at any time; or
  5. committed fraud related to your Sesame Cash account or with the use of your Sesame Cash account.
How to File a Complaint

If you have a complaint regarding your Sesame Cash account, please contact us at 1-877-751-1859, and we will do our best to address the problem. You may also file a complaint with the Consumer Financial Protection Bureau (“CFPB”). For more information, you can visit the CFPB’s website.

Choice of Law

These Terms of Service are governed by the laws of California.

Arbitration

Subject to all other terms of this Terms of Service, and to the extent not prohibited by law, you agree that any claim of any kind arising from or related to this Terms of Service or the use of the Sesame Cash account against us, our affiliates, or the parties with whom we contract in order to offer the Sesame Cash account and related services (i) shall be resolved by final and binding arbitration conducted by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules in your state of residence at a location that is reasonably convenient for both parties and (ii) shall not be brought through class or individual litigation proceedings. If such a claim is advanced by class proceeding by any other person on your behalf, you will opt out of, or not opt into, such proceedings as circumstances dictate.

Changes to this Agreement

These Terms of Service are available at www.creditsesame.com and through the Credit Sesame Mobile App.

Credit Sesame may make changes to the Terms of Service at any time and for any reason. If we make changes that result in higher fees, greater consumer liability, fewer types of available transfers, or stricter limits on the frequency or dollar amount of transfers, we will notify you in writing about these changes by mail or email (see “How Credit Sesame Will Contact You” above) at least 21 days before we make the change. If you do not agree to these changes, you can let us know and we will close your Sesame Cash account. If we do not hear from you, we will assume that you agree to the changes we have made.

Limitation of Liability

Except as otherwise expressly provided in this agreement or as otherwise required by applicable law, we, our affiliates, and the parties with whom we contract in order to offer the Sesame Cash account and related services are neither responsible nor liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating in any way to the Sesame Cash account, any products or services purchased using the Sesame Cash account, or these Terms of Service.
